Legal Scales Procedure for Request to Inspect, Examine or Copy Public Records

All requests for public records shall be in writing. To submit a public records request by mail or fax, complete a Request to Examine and/or Copy Public Records (pdf) form and mail or fax it to the attention of the appropriate ISDA program, as indicated on the form.

An email request may be submitted to PublicRecordRequest@idahoag.us, and must contain a name, mailing address, email address and telephone. The telephone number will be used to clarify the request should there be any questions (Idaho Public Records Law Manual, Office of the Attorney General, 2007). In order to ensure that email requests are answered in a timely manner, all email requests must be sent to this email address.

ISDA shall either grant or deny a written request for public records within three (3) working days of the date of receipt of the request. A public records request will be deemed to be received via email when it is opened by an ISDA employee. This time may be extended for ten (10) working days from the date of the request if it is determined that a longer period of time is needed to locate or retrieve the public records (Idaho Public Records Law Manual, Office of the Attorney General, 2007). The requestor will be notified in writing via the method of request email, regular mail or fax if a time extension is necessary.
